Gifthorse Promotions is the branded products division of Real Print Management Limited. 

These are the terms and conditions of Gifthorse Promotions, which is the company that sells goods to customers on the Website. If you access the Website, and/or place an order for goods, you agree to be bound by these terms and conditions.

How to order

Select the goods you require from the Website, add to Cart and click ‘View Cart’;

Review your Cart making sure that all quantities and specifications such as size (see our sizing chart) and colour fit your requirements, then click “Proceed to Checkout”;

You must enter your billing and delivery address, e-mail address and phone number correctly in the billing details section as the system is automated and is not manually reviewed for obvious errors;

You will then proceed to the secure payment page, where you may select the payment type and complete your order. Your payment will be collected from you by Real Print Management Limited. Following submission of your order you, will be sent an automated order acknowledgment to the email address provided.


Method of payment

For online payments, we currently accept PayPal and Stripe plus all major credit cards such as Visa Debit, Visa, Mastercard. PayPal and Stripe are safe payment methods for purchases online. You can use PayPal or Stripe as a pay path to pay via your Visa Debit, Visa, Mastercard and most major credit cards. You have the option of checking out as a guest using your PayPal or Stripe account or set up an account. Prices are shown in £ Sterling.

The amount deducted will be in Sterling. PayPal, Stripe and your credit card provider will convert to your currency at the checkout. We have no control over the real-time currency exchange rate. The full amount payable will be shown at the checkout. By paying this amount, you have agreed to the real-time exchange rate offered by PayPal, Stripe or credit card provider. We are not responsible for any further transaction charges incurred by your bank or credit card provider.

You will receive an invoice from PayPal and Stripe upon completion of your transaction should you pay via PayPal or Stripe. You should then receive a confirmation email from us. Should you not receive this within 10 hours of your transaction, please contact us at sales@gifthorse.co.uk 


After you have made your purchase

You should receive the following via email:

An order summary with order number e.g.#4067 from www.gifthorse.co.uk 

If you do not receive this within 10 hours of purchase, please email us at sales@gifthorse.co.uk

It is important that you enter your full address correctly at the time of ordering. This is the responsibility of the Customer. Please review your address upon opening a store account or ordering. Should you notice on your receipt that you have mis-spelt or included incorrect details, please contact us immediately, as once goods are despatched we cannot be responsible for errors made on your address. Our address labelling is automated and cannot pick up on errors or omissions. Orders shall not be resent/refunded/cancelled should an address error be made.

By placing an order through the Website, you warrant that you are legally capable of entering into binding contracts.


How the contract for the goods is formed between you and Gifthorse Promotions

After placing your order you will receive an automated acknowledgment. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by Gifthorse Promotions. You will receive an email confirming that Gifthorse Promotions has accepted your order when your order has been processed and is ready for despatch from the Gifthorse Promotions warehouse.

Once Gifthorse Promotions accepts your order, a contract to purchase the goods from Gifthorse Promotions takes effect between you and Gifthorse Promotions. This means that you will own the goods prior to your goods being despatched from the Gifthorse Promotions warehouse. This applies whether the goods are collected (i) on your behalf by Courier or any other courier that you contract with to deliver your goods to you; or (ii) by you in person; or (iii) despatched by Gifthorse Promotions. For the avoidance of doubt, where you have appointed a Courier to collect and deliver your goods for you, you agree that Courier take possession of the goods on your behalf when they collect the goods at the Gifthorse Promotions warehouse.

The contract to sell goods to you only relates to those goods listed in the confirmation email and by placing your order you agree to our Terms and Conditions, Delivery Terms and Returns Policy.

You will be charged before your order has been processed and is ready for despatch or collection by you or your courier at the Gifthorse Promotions. In the event of us not being able to fulfil your order within a reasonable timeframe we will immediately contact you to discuss whether you wish to wait for the product/cancel the order/order something else or a different size.

 

Our goods

A description of the main characteristics of goods can be found on the product pages of the Website.

Prices for goods on the Website appear on the product pages and include all applicable taxes.

Prices and offers may vary and may only be available for limited periods. All prices and offers are subject to availability and may be withdrawn or amended at the discretion of Gifthorse Promotions. The prices on the Website may differ to prices in retail stores, catalogues or elsewhere.

The Website contains a large number of goods and it is possible that, despite our best endeavours, some of the goods listed on the Website may be incorrectly priced. If Gifthorse Promotions discovers an error in the price of the goods you have ordered, Gifthorse Promotions will inform you as soon as possible. Gifthorse Promotions will give you the option of reconfirming your order at the correct price or cancelling it.

Gifthorse Promotions is under no obligation to sell incorrectly priced goods to you at the incorrect price.

Goods being collected by your courier or collected by you at the Gifthorse Promotions warehouse will be at your risk when such goods are collected by you or your courier (or Courier’s agent) for you from the Gifthorse Promotions warehouse.

Some offers carry a maximum quantity per customer. If this is applicable, this is detailed on the individual offer.


Ex-display

Any goods showing ex-display on the image are heavily marked down in price to clear. They may have been a display model in a Gifthorse Promotions store and as such may show signs of discolouration, slight marks and evidence of prior fitting. Faults are NOT of a serious or structural nature and are usually minor marks.

 

Gift cards

Only Gift Cards issued by Gifthorse Promotions can be used to buy goods from Gifthorse Promotions.


Fraud prevention

To help Gifthorse Promotions prevent fraud, orders of £250.00 or more may require a landline telephone number. Card fraud is illegal and perpetrators will be prosecuted.

 

Delivery costs

Delivery costs are additional to the displayed price and will be confirmed to you before your order is accepted.

If your order is particularly heavy it may be subject to extra delivery charges. If any order is subject to extra delivery charges you will be advised of the additional cost before your order is collected from the Gifthorse Promotions warehouse by our courier. You have the option to cancel the order if you do not wish to pay any additional delivery costs.

 

Embroidered products

We will embroider garments in the most appropriate position so as to not affect the garment’s structure or performance in accordance with manufacturer’s guidelines. This may vary from the images on the Website depending on the style of product. Please ensure that any spelling or numbers chosen are correct and that the size of the product is correct, as any mistakes cannot be rectified once your order has been placed. As with any personalised products once a product has been embroidered it is non -returnable and will take an additional 2 week processing time after you have received your order acceptance confirmation email.

 

Warranty and limitation of our liability

If Gifthorse Promotions fails to comply with these terms and conditions, Gifthorse Promotions shall only be liable to you for the purchase price of the goods and any proven losses that you suffer as a result of Gifthorse Promotions failure to comply (whether arising in contract, tort (including negligence), breach of statutory duty or otherwise) which are a foreseeable consequence of such failure.

Gifthorse Promotions will not be liable for losses that result from its failure to comply with these terms and conditions that fall into the following categories:

(a) loss of income or revenue;

(b) loss of business;

(c) loss of profits;

(d) loss of anticipated savings;

(e) loss of data; or

(f) waste of management or office time.

Nothing in these terms and conditions is intended to exclude or limit Gifthorse Promotions liability for:

(a) death or personal injury caused by Gifthorse Promotions negligence;

(b) fraud or fraudulent misrepresentation;

(c) defective products;

(d) any other matter for which it would be illegal for Gifthorse Promotions to exclude or attempt to exclude its liability.

Whilst Gifthorse Promotions adopts industry standard protections against computer viruses, it is not able to warrant that this Website is free from computer viruses or any other malicious or impairing computer programme.

Nothing in these terms and conditions is intended to affect your statutory rights.

 

Events outside of our control

Gifthorse Promotions will not be liable or responsible for any failure to perform, or delay in performance of any of its obligations to you that is caused by events outside Gifthorse Promotions reasonable control (a ‘Force Majeure Event’). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Gifthorse Promotions reasonable control and includes (without limitation) the following:

(a) Strikes, lock-outs or other industrial action;

(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

(e) Impossibility of the use of public or private telecommunications networks; or

(f) The acts, decrees, legislation, regulations or restrictions of any government.

In the event of a Force Majeure Event, Gifthorse Promotions performance is deemed to be suspended for the period that the Force Majeure Event continues and Gifthorse Promotions will have an extension of time for performance for the duration of that period. Gifthorse Promotions will use its best endeavours to bring the Force Majeure Event to a close or to find a solution by which its obligations to you may be performed despite the Force Majeure Event.

 

Written communications

Applicable laws require that some of the information or communications Gifthorse Promotions sends to you should be in writing. By accessing the Website, you accept that communication with Gifthorse Promotions will be primarily electronic through email or notices posted on the Website. For contractual purposes, by accessing the Website you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that Gifthorse Promotions provides to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

 

Intellectual property rights

Unless otherwise specified the intellectual property rights in the contents of all the pages in this Website, are owned or licensed to Gifthorse Promotions, or are used with permission from the owner.

The contents of this Website may not be copied, reproduced, modified, downloaded or used in any form without our prior written permission.

 

Complaints

Gifthorse Promotions takes all feedback very seriously and aims to deal with complaints as quickly and effectively as possible.

To assist Gifthorse Promotions in dealing with your complaint, please detail all aspects of the complaint, your order number and your contact details.

 

Our right to vary these terms and conditions

Gifthorse Promotions reserves the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions that are in force at the time that you order goods from Gifthorse Promotions unless:-

any change to these terms and conditions is required to be made by law or governmental authority, in which case the changes may apply to orders previously placed by you; or

Gifthorse Promotions notifies you of any changes to these terms and conditions before it accepts your order, in which case Gifthorse Promotions has the right to assume that you have accepted the change to the terms and conditions unless you notify Gifthorse Promotions to the contrary within seven (7) working days of receipt by you of the goods.

Safety Warning

Physical activities can be hazardous. The selection and use of suitable equipment requires skill and you should ensure that you are appropriately equipped and trained. In the interests of your safety and the safety of others, you should also ensure that you are properly trained in the techniques you will need to employ in pursuit of your chosen activity. Gifthorse Promotions recommends that you seek and take the advice of a suitably qualified person before purchasing your equipment. Once purchased, the equipment should only be used in accordance with the manufacturers’ instructions and should likewise be inspected before use and properly maintained. Nothing in this notice affects your statutory rights.

 

WEEE regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The Directive also means that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge.

Goods are marked with the crossed out wheeled bin symbol to show that they were produced after 13 August 2005, and should be disposed of separately from normal household waste so that they can be recycled.

Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

Gifthorse Promotions is obliged under this Directive to offer its customers free take-back of their WEEE on a like-for-like basis when you buy from Gifthorse Promotions a new Electrical or Electronic product.

For example, if a customer bought a new battery/watch/pedometer from Gifthorse Promotions, Gifthorse Promotions would accept their old battery/watch/pedometer and prevent it going into a landfill site by disposing of it safely. Customers must return their WEEE item to Gifthorse Promotions within 28 days of purchasing their new item.

 

Jurisdiction

These terms and conditions shall be subject to the laws of the England and Wales and the courts of England and Wales shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms and conditions including orders for goods.
